Hikma Injectables USA Inc. d/b/a Hikma 503B (“Hikma”) Return Goods Policy (this “Policy”) applies to the return and/or credit of product(s) purchased by a direct customer of Hikma. Unless otherwise required by regulation or law or expressly agreed by the parties, the following policy applies to Hikma product(s) with labeler code 63037.


  • Does not contain Hikma 63037 labeler code.
  • Expired product(s).
  • An inner unit included within a saleable package with a different NDC.
  • Private Labeled, Repackaged, Reconstituted, and/or Contract Manufactured product(s).
  • Damaged product(s) due to insurable causes, such as fire, flood, and/or natural disasters.
  • Damaged/deteriorated product(s) due to customer negligence, including, but not limited to improper handling or storage by the customer.
  • Purchased or distributed contrary to federal, state or local laws.
  • Products which are purchased in error due to no fault of Hikma.
  • Products which are defaced or missing Hikma labels which do not clearly display the expiration date, NDC or lot number.
  • Products which are returned from outside of the United States and its territories, commonwealths and possessions.

  • Mis-shipment (received incorrect item).
  • Overage (received greater quantity than ordered).
  • Damaged/deteriorated product(s) not due to the negligence, improper handling, or storage by the customer.
  • Product which is expiring within twenty-one (21) days of the shipment date by Hikma without prior approval from customer, except for products which are advertised, identified, and sold as short-dated or listed on our Hikma 503B Quick Ship Products page

NOTE:  If product is received in error, customer has the option to keep additional product and be invoiced accordingly.


  • Claims must be submitted on to determine eligibility. Damaged product returns must include submission of pictures evidencing claimed damage. Eligibility determination is made solely by Hikma at its sole discretion.
  • Claims must be made within twenty-four (24) hours of receipt for controlled products, and three (3) business days of receipt for non-controlled products.
  • Product accepted for return must be shipped to: Inmar RX Solutions, Inc, 3845 Grand Lakes Way, Suite 125, Grand Prairie, TX 75050.
  • All product returns must be accompanied by the Return Authorization (“RA”) received by customer from Hikma.
  • Returns must be received by Inmar within ten (10) business days of the date assigned on the RA.


  • Credit for returned products will only be issued by Hikma in the form of a credit memo.
  • Hikma shall process credit memos upon receipt and processing of validated returns by Inmar.
  • Credit will be issued based upon the net invoice price at the time of original purchase.
  • Any and all credits that are not redeemed within one (1) year of issuance shall be null and void.
  • The amount of credit issued or authorized by Hikma is directly correlated to what is validated by Inmar. In the event of any conflict between the customer’s claimed quantity and the quantity validated by Inmar, the quantity validated by Inmar shall control. Inmar’s physical count of the returned products will be final.
  • For recalled product, current net invoice price will be credited.


  • In the event of a withdrawal or recall, Hikma will issue instructions to customer.
  • Hikma reserves the right to solely determine whether items qualify for return and credit pursuant to this Policy.
  • Issuance of a RA number and/or submission of a return does not guarantee credit or constitute Hikma’s acceptance of such return.
  • Sales representatives are expressly prohibited from authorizing returns, issuing credit and/or receiving returned products.
  • By returning products, you authorize Hikma and Inmar, as Hikma’s agent, to destroy, without payment or other recourse, any returned product.
  • Set-offs are expressly prohibited. No unauthorized deductions for returned product(s) will be accepted.
  • Non-Hikma product(s) returned to Inmar will not be the responsibility of Hikma. Hikma reserves the right to charge customers for any costs incurred toprocess and destroy non-Hikma product returned to Inmar.
  • Once received by Inmar, product will not be returned to the customer.
  • Hikma is not responsible for lost or damaged shipments of returned product(s). Insuring and tracking shipments are the responsibility of the customer.
  • This Policy supersedes all previous policies and may be modified by Hikma at its sole discretion.
